If the power goes out after an earthquake (happened in 2006) or if a last minute tsunami warning/watch get issues and the cell or land line phones get that dreaded "all circuits busy" message, you'll feel much better knowing your guests have our emergency instructions booklet with advice and directions to the closest emergency shelters.

Hawaii Act 204 is now the law for vacation rentals!

Act 204 places strict requirements on the owners and operators of transient accommodation rentals.

Fines are $500 a day up to $5000 a day and just this past February 2016
State of Hawaii
just hired (Maui News) more inspectors to issue citation for non-compliance owners!

A major requirement from this newly enacted law is that owners and landlords who reside outside of the state or on another island to designate an an On Islands Agent to act on the owners behalf and have this information be prominently displayed IN the unit.  The state has deemed a local contact is "essential" to guests in the case of an emergency or natural disaster.  Your guests, whom this law was written to protect, deserve to have the phone be answered during an emergency!

Other Act 204 Requirements:

  • You must designate an On-Island local contact. (Must be someone living on the island)
  • Display the local on-islands contact name, phone number and email address INSIDE THE UNIT.
  • Provide the local contact information either in online advertisements or to the guest upon check-in.
  • The TAT license number must be displayed INSIDE the unit and in all online advertisements (link or displayed)
Act 204 Penalties:
  • $     500 per day for the 1st violation.
  • $  1,000 per day for the 2st violation.
  • $  5,000 per day for the 3rd violation.

We know what your thinking...I'll save money and ask my condo cleaner, Realtor or neighbor!  While there is nothing in the law that states you can't designate your neighbor, a local friend, Realtor or a condo cleaner to be your on island contact but do they really understand what it means to be designated your "On Island Contact emergency person and more importantly, are they willing to accept that responsibility?
  • Are THEY willing to have their contact information displayed on all your advertising, on every one of your rental agreements and displayed in your unit?

  • Is your designated contact really going to be answer or take that call late at night about a leak that could cost you thousands in damages?
  • As an owner, can you be sued for not designating someone reliable?  Just asking!
  • Are you really willing to put your investment in the hands of some "local" person who isn't license or insured?
  • What happens when your guests get your condo cleaners personal voice mail?  What's it say?
  • Can you imagine your guests confusion when they call our condo cleaner and get her personal voicemail?
  • You'll have to change all your documentation, advertising and signs if that person moves, does something different or change jobs?  We're not going anywhere!!!

Maui On Islands Contacts Llc. is associated and owned by the same owner of Maui Sea Breeze Vacation Rentals Llc. We decided to start this new division to fill the need for self managed owners in providing a reliable on island contact person.  We have an office right in Lahaina just above Radio Shack, our staff answers the phone during office hours and we have an answering service.  We're insured and licensed by the state of Hawaii and most importantly, we already handle all types of rental situations.  How much more secure can you feel knowing your designated local contact is an actual company with offices in Lahaina who already handling daily rental issues.


The difference between Act 204 vs ACT 326:
Act 204, formally know as Act 326, removed the obligation from condo associations placed in act 326 and now places the responsibility directly on the owners themselves.

Basic $ 99 monthly program
(This plan is for owners who want us to handle emergency issues only and comply with Act 204 requirements)
Registered Certificate will direct call guests to call the owner for all rental issues but US for emergencies or if the owner can't be contacted.
  • A customized, in unit registration certificate and emergency booklet will be mailed to you with all the required state information.  This certificate will direct the guests to call the OWNERS for all rental issues but to contact us for any emergencies or if the owner can't be reached.
  • Permission to use our information as required by the State of Hawaii to display on all online and print advertising, including rental agreements, our state licensed company name, phone numbers and email address.
  • 4 phone calls a month at no charge. No carryovers.
  • $50/hour for any additional services, calls or request beyond the 2 free per month. Billed in 15 min increments.
Our Basic +  $299 monthly program
(This plan is for owners who want US us to handle ALL GUEST issues while guests are on the island)
Registration Certificate will direct the guests to call US for all rental issues and emergencies.
  • A customized, in unit registration certificate and emergency booklet will be mailed to you with all the required state information.  This certificate will direct the guests to call the US for all on island rental issues.
  • Permission to use our information as required by the State of Hawaii to display on all online and print advertising, including rental agreements, our state licensed company name, phone numbers and email address.
  • 12 phone calls a month at no charge. No carryovers.
  • $50/hour for any additional services, calls or request beyond the 2 free per month. Billed in 15 min increments.
Satisfaction:
For $99 a month, you'll sleep much better at night knowing you've met the requirements set for by the state by assigning a licensed Hawaii Condo Hotel Operating company and not just some neighbor or condo cleaner who may or may not be available nor have proper insurance.

Additional Fees:
(Note:  If you stay within your plans FREE phone call limits there should be now other fees other than your normal $99 monthly fee) 4 Free Emergency Phone Calls Per Month)

Initial Set Up Fee:
$75 Initial set up fee to pay for the printing and mailing of your island area's SPECIFIC Emergency Instructions Booklet (Evacuation maps and locations differ depending on what part of the island your on)

If you exceed your plans call allowance, you can either bump up to the next plan or pay $35/hour additional hourly rates for managing the situation. (Charges based on 15 minute increments)

Registration Certificate in unit Sign Changes:  (This pays for the re-printing and mailing of any changes)

Example:  If you need us to re-update your registration certificate sign with new contact or tax info and have it re-posted in the unit. This cost pays for the re-printing and mailing of the certificate.

SPECIAL NOTES:

If you're in our rental program, we provide this service for free and it is included in out 25% commission structure!  

However, if you prefer managing your own vacation rental we're offering our professional name and 24 hour a day answering service to be your on island contact in case of emergencies.
